The Team
The BC Prosecution Service (BCPS) plays a crucial role in protecting society by independently, effectively, and fairly conducting prosecutions and appeals at all levels of court. With a dedicated team of approximately 550 Crown Counsel across British Columbia, we are organized into five regions: North, Interior, Fraser, Vancouver, and Vancouver Island-Powell River. Additionally, we have specialized criminal appeals and special prosecutions offices in Vancouver and Victoria, with our provincial headquarters located in Victoria.

This position will be based in the Commercial, Police & Regulatory (CPR) section which is in the Criminal Appeals and Special Prosecutions (CASP) division of the BCPS.

CASP is responsible for the following areas of practice: (1) all indictable criminal appeals undertaken to the Court of Appeal for British Columbia and the Supreme Court of Canada, including interventions [Criminal Appeals Section]; (2) prosecutions involving commercial, police and regulatory prosecutions; (3) organized and major crime prosecutions; (4) providing prosecutorial litigation support to other prosecution offices within the BCPS in respect of constitutional challenges that arise in the trial courts [Prosecution Support Unit]; (5) the delivery of legal resources and learning and development opportunities for the BCPS; (6) French and bilingual prosecutions; (7) the administration of matters before the BC Review Board.

The Role
CPR Crown practice in diverse areas of the law, with conduct of serious, complex, or lengthy cases that require special knowledge and expertise. CPR prosecutes cases throughout BC.

Generally, CPR files may involve:

  • Pre-charge advice
  • Disclosure and information-sharing issues
  • Complex legal issues
  • Relationships of trust, vulnerability, or authority between perpetrators and victims
  • Concurrent regulatory, administrative or civil proceedings
  • Corporate offenders
  • Multiple jurisdictions
  • High profile cases
  • Significant public interest considerations

The areas within CPR’s mandate are:

  • Prosecutions focused on business, finance, commerce, money laundering, proceeds of crime, or forfeiture;
  • Conduct of files involving criminal charges against police officers referred by the Independent Investigations Office and other agencies including offences resulting in death or serious harm or breach of trust allegations;
  • Management and conduct of Criminal Code prosecutions or regulatory prosecutions under provincial statutes, including occupational health and safety (such as serious workplace injuries or fatalities), environmental, animal welfare and securities prosecutions, and other regulatory areas that warrant quasi-criminal prosecution.

Job Requirements:
Education:

  • Membership in good standing in the Law Society of British Columbia or membership in good standing in another Canadian Law Society and immediately eligible to become a member of the Law Society of British Columbia.  PLEASE INCLUDE YOUR CALL DATE IN YOUR APPLICATION.

Experience:

  • Crown Counsel Level 1: Counsel in their 1st to 5th year of call, with a minimum of 3 years of recent experience as a called and practicing lawyer in Canada with a primary focus in the area of criminal law or reasonably comparable quasi-criminal law and/or regulatory law experience. 
  • Crown Counsel Level 2: Counsel in their 6th to 11th year of call, with a minimum of 3 years of recent experience as a called and practicing lawyer in Canada with a primary focus in the area of criminal law or reasonably comparable quasi-criminal law and/or regulatory law experience.
  • Crown Counsel Level 3: Counsel in their 12th year of call or greater, with a minimum of 3 years of recent experience as a called and practicing lawyer in Canada with a primary focus in the area of criminal law or reasonably comparable quasi-criminal law and/or regulatory law experience.

Preference may be given to applicants with:

  • Experience in conducting complex criminal or regulatory prosecutions.
  • Experience in conducting criminal jury trials.
  • Experience conducting charge assessments.
  • Background in a topical area within the mandate of CPR.
  • Exceptional written and oral advocacy skills.

Proviso:

  • Travel is a requirement.  Transportation arrangements must meet operational requirements of the ministry.
  • Crown Counsel must be ready, willing, and able to routinely:
    • deal with disturbing cases, including images of child sexual assault and child sexual abuse;
    • deal with victims and witnesses who have been subjected to or witnessed traumatic events, including sexual abuse, catastrophic injuries, and death, or have suffered other forms of extreme personal loss;
    • deal with traumatic violence or death scenes including images of and evidence about deceased persons with catastrophic injuries;
    • manage sensitive, graphic, and highly confidential information; and,
    • be the object of negative public or media comment or criticism with limited ability to respond.

About this Position:
CASP has one temporary Crown counsel Level 1/2/3 position available in the CPR section in Vancouver, available until May 9, 2026.
Flexible work options are available; this position may be able to work up to 3 days at home per week as per the Telework Agreement.
