This is a restricted lateral posting open to employees who hold a Band 2 base position.

Job Overview
Independent Correctional Adjudicators are responsible for conducting hearings to determine whether an incarcerated person breached a rule under the CAR and, if so, whether to impose a penalty and in what form. The disciplinary process and available penalties are outlined in the CAR.

Adjudicators are also responsible for producing timely, clear, concise, and well-reasoned decisions based on the evidence presented, relevant legislation, and applicable legal principles. In almost all cases, Adjudicators provide written decisions within hours of the hearing. Such decisions must be (and be seen to be) made in an impartial, fair, and transparent manner. This expectation applies to process decisions, outcomes, how Adjudicators interact with hearing participants, and how their decisions are communicated.

Adjudicators participate in hearings primarily through remote communication methods, such as video conferencing.

Qualifications:
Education and Experience Requirements

  • Post-secondary degree, diploma, or certification in a related discipline such as law, criminology, public administration, or dispute resolution, and a minimum of one (1) year recent* and demonstrated experience in the application of administrative law; OR
  • Post-secondary degree, diploma, or certification in an unrelated discipline, and a minimum of one (1) year recent* and demonstrated experience in formal adjudicative decision-making**; OR
  • An equivalent combination of education, training, and experience may be considered.

* Recent experience is defined as within the last three (3) years.

** Experience in formal adjudicative decision-making includes:

  • Reviewing and analyzing submissions and evidence from multiple parties;
  • Assessing the relevance and reliability of evidence, and making findings of fact; and
  • Taking into consideration applicable legislation, policy, and the principles of administrative fairness.

SPECIAL REQUIREMENTS

In addition to the above requirements, Independent Correctional Adjudicators are required to:

  • Travel as needed, sometimes on short notice;
  • Possess a valid class 5 BC driver’s licence; and
  • Maintain membership with the BC Council of Administrative Tribunals.

Applicants must not have been employed at any time in the previous five (5) years by:

  • A correctional authority to work in a correctional centre, penitentiary, probation office or parole office; 
  • A sheriff service to work as a peace officer;
  • A policing agency to work as a peace officer; or
  • A prisoner advocacy organization, unless that person is a member of (or is eligible for membership to) a Law Society of a province or territory of Canada.

Exemptions:

  • An applicant who is employed to work at a Corrections Branch headquarters and has not, at any time in the previous five (5) years, been employed to work in a correctional centre, penitentiary, probation office, parole office or as a peace officer for a sheriff service or policing agency.
