This is a restricted lateral posting open to employees who hold a Grid 21 base position.

Job Overview

Acting with delegated authority, the position independently exercises discretion over the commencement of property forfeiture proceedings.

The position requires a significant understanding of forfeiture theory and specialized knowledge of the common law, Charter, Criminal Code, Controlled Drugs and Substances Act, Cannabis Act and other statutes under which law enforcement agencies operate. The position must consider previous decisions and assessments and their impact on a given case when exercising discretion.  Once a decision is rendered it cannot be varied or reviewed; the decision is only open to being challenged in court.

Qualifications:
Education and Experience Requirements

  • Post-secondary degree and a minimum of one (1) year of *related experience; OR
  • Diploma in law, justice, or business, and two (2) years’ *related experience.

*Related experience:

  • Applying the principles of administrative law and natural justice.
  • Interpreting and applying legislation, regulations, and common law in complex situations.
  • Writing clear and concise decisions/rationales for the benefit of clients/respondents.
  • Recent (within 2 years) experience rendering decisions concerning benefits and entitlements, or property rights and forfeiture at or above a total value of $5,000 per occurrence

Preference may be given to candidates with one or more of the following:

  • Experience interpreting and applying legislation, regulations, and policies governing a Canadian forfeiture program.
  • Experience working with a law enforcement or forfeiture agency.

This position can be based out of any of the locations listed above.
Flexible work options are available; this position may be able to work up to 4 days at home per week subject to an approved telework agreement.
An eligibility list may be established to fill future temporary and permanent vacancies.
A Criminal Record Check (CRC) will be required.
Employees of the BC Public Service must be located in BC at the time of employment.
