Job Overview
Taxpayers may appeal assessments, rejected refunds, disentitlements and certain other decisions of statutory officials under numerous taxation and revenue statutes. The Tax Appeals and Litigation Branch performs an impartial review of all such appeals and submits a recommendation to allow, vary or deny the appeal. Ministerial decisions may be further appealed to the courts, and the branch manages all such litigation.
The branch deals with a wide range of taxpayers including individuals, corporations and multinational companies as well as their legal and financial representatives. Appeals and litigation involve complex legal and accounting issues across a variety of businesses and industries, and outcomes on appeal can significantly affect the tax base.
As the final point before the court system, the appeals program is critical to the ministry in delivering fair tax administration, serving the taxpaying public, protecting their rights, ensuring appropriate compliance and preventing loss of revenue.
An Appeals Officer must be able to assimilate complex facts, assess the merits of legal arguments, weigh the evidentiary value of material and analyze applicable legislation. Upon completion of their review, the Appeals Officer prepares a written recommendation on the disposition of each appeal. The Appeals Officer regularly interacts with taxpayers, their professional advisors and the assessing sections of the ministry.
Qualifications:
Education and Experience Requirements
- Holds a Canadian professional accounting designation (CA, CGA, CMA or CPA) and is a member in good standing.
- Several years auditing experience involving exposure to a wide variety of businesses and industries, including preparing financial statements and preparing or auditing personal and corporate tax returns.
- Experience analyzing complex factual, business or legal issues.
